WashingtonAI TransparencyAn Act Relating to Informing Users When Content is Developed or Modified by Artificial IntelligenceHB11702/1/2027

• Defines “covered provider” as a person or entity that creates, codes, or otherwise produces a generative artificial intelligence system with over 1,000,000 monthly users, which is publicly accessible to consumers for personal use within the geographic boundaries of the state. This definition does not apply to state, local, or tribal governments.
• Requires covered providers to include provenance data in image, video, or audio content, or content that is any combination thereof, that has been created or materially altered by the provider’s generative artificial intelligence system. Covered providers must also make it technically and commercially difficult to remove or tamper with these disclosures. 
• Establishes an exception for any product, service, website, or application that is exclusively a video game or interactive experience, including e-commerce services. An exception is also made for systems used exclusively for upscaling, noise reduction, or compression.  

Violations of the law are unfair or deceptive acts under Washington's Consumer Protection Act. 

WashingtonAI in GovernmentAn Act Relating to Informing Users When Content is Developed or Modified by Artificial IntelligenceHB11702/1/2027

• Requires any government agency that makes available an artificial intelligence system intended to interact with consumers to disclose to each consumer, before or at the time of interaction, that the consumer is interacting with an artificial intelligence system.

WashingtonAI HealthcareAn Act Relating to Making Improvements to Transparency and Accountability in the Prior Authorization Determination ProcessSB53956/11/2026

• Prohibits health carriers from using artificial intelligence to unilaterally decide to deny, delay, or modify health care services. 
• Amends RCW 48.43.830, RCW 41.05.845, 2025 c 25 s 1, 2025 c 25 s 2, and 2025 c 227 s 8 to codify protections requiring carriers that use artificial intelligence for prior authorization to ensure it is applied equitably, complies with state and federal anti-discrimination laws, and bases determinations solely on an enrollee’s medical history, demographic data, and individual clinical circumstances. Furthermore, the AI’s performance must be reviewed periodically for accuracy and reliability.

Existing penalties apply under amended laws.

• Operators must clearly and conspicuously display a notification at the beginning of any AI companion interaction and at least every three hours for continuing interactions that the AI companion chatbot is artificially generated and not human. 
• Operators must implement reasonable measures to prohibit and prevent AI companion chatbots from claiming to be human or making comments that conflict with the disclosures above. 
• Operators must implement measures where the operator knows a user is a minor (under 18) to disclose that the user is interacting with AI (at the beginning of the interaction and at least every hour during continuous interactions), prevent the bot from generating or producing sexually explicit content or suggestive dialogue, and prohibit the use of manipulative engagement techniques which cause the bot to engage in or prolong an emotional relationship with the user. 
• Prohibits any operator from making available or deploying an AI companion chatbot unless it maintains and implements a protocol for detecting and addressing suicidal ideation or expressions of self-harm by users.
